Does law matter regarding public health outcomes? Regardless of what one may think about the answer to this age-old question, in recent years the public health community has increasingly demonstrated and recognized the roles that public health laws and policies play in effectuating long-lasting and broad-based population-wide changes. Public health laws and policies have been instrumental in the following ways: reducing smoking prevalence; reducing underage alcohol-related drinking, driving, crashes, and fatalities; reducing exposure to second-hand smoke; eliminating vaccine–associated paralytic poliomyelitis ; (...) increasing seat-belt use and reducing traffic fatalities; reducing dental carries; and reducing access to and consumption of unhealthy foods and beverages sold in schools and to reductions in caloric intake and overweight. In fact, in a review of the ten greatest public health achievements in the 20th century, all were influenced by policy change. (shrink)

Despite governmental and private antismoking initiatives, tobacco smoking remains a significant public health and economic challenge. The Centers for Disease Control and Prevention estimates that for each year between 1997 and 2001, cigarette smoking and exposure to secondhand smoke caused approximately 438,000 U.S. residents to die prematurely, resulting in 5.5 million years of potential life lost, and in $92 billion dollars of lost productivity. Also, despite convincing scientific data that laws against indoor smoking protect people from the negative health effects (...) of cigarette smoke, not all states have afforded their residents this protection. As of July 2007, 16 states neither restricted nor banned indoor smoking in restaurants, private worksites, or government worksites, and many state statutes only required separate rooms for smokers rather than eliminating all smoking inside buildings. In several states, local governments have attempted to fill this gap by adopting their own antismoking measures. (shrink)

Both unipolar and bipolar depression have been linked with impairments in executive functioning. In particular, mood symptom severity is associated with differences in common EF, a latent measure of general EF abilities. The relationship between mood disorders and EF is particularly salient in adolescence and young adulthood when the ongoing development of EF intersects with a higher risk of mood disorder onset. However, it remains unclear if common EF impairments have associations with specific symptom dimensions of mood pathology such as (...) blunted positive affect, mood instability, or physiological arousal, or if differences in common EF more broadly relate to what is shared across various symptom domains, such as general negative affect or distress. To address this question, bifactor models can be applied to simultaneously examine the shared and unique contributions of particular mood symptom dimensions. However, no studies to our knowledge have examined bifactor models of mood symptoms in relation to measures of common EF. This study examined associations between common EF and general vs. specific symptom dimensions using structural equation modeling in adolescents and young adults with varying severity of mood symptoms. A General Depression factor capturing shared variance across symptoms statistically predicted lower Common EF. Additionally, a factor specific to physiological arousal was associated with lower Common EF. Anhedonia-specific and Mania-specific factors were not significantly related to Common EF. Altogether, these results indicate that deficits in common EF are driven by, or reflect, general features of mood pathology that are shared across symptom dimensions but are also specifically associated with physiological arousal. Although Karl Marx and Søren Kierkegaard are both major figures in nineteenth-century Western thought, they are rarely considered in the same conversation. Marx is the great radical economic theorist, the prophet of communist revolution who famously claimed religion was the "opiate of the masses." Kierkegaard is the renowned defender of Christian piety, a forerunner of existentialism, and a critic of mass politics who challenged us to become "the single individual." But by drawing out important themes bequeathed them by their shared (...) predecessor G. W. F. Hegel, Jamie Aroosi shows how they were engaged in parallel projects of making sense of the modern, "dialectical" self, as it realizes itself through a process of social, economic, political, and religious emancipation. In The Dialectical Self, Aroosi illustrates that what is traditionally viewed as opposition is actually a complementary one-sidedness, born of the fact that Marx and Kierkegaard differently imagined the impediments to the self's appropriation of freedom. Specifically, Kierkegaard's concern with the psychological and spiritual nature of the self reflected his belief that the primary impediments to freedom reside in subjectivity, such as in our willing conformity to social norms. Conversely, Marx's concern with the sociopolitical nature of the self reflected his belief that the primary impediments to freedom reside in the objective world, such as in the exploitation of the economic system. However, according to Aroosi, each thinker represents one half of a larger picture of freedom and selfhood, because the subjective and objective impediments to freedom serve to reinforce one another. By synthesizing the writing of these two diametrically opposed figures, Aroosi demonstrates the importance of envisioning emancipation as a subjective, psychological, and spiritual process as well as an objective, sociopolitical, and economic one. The Dialectical Self attests to the importance and continued relevance of Marx and Kierkegaard for the modern imagination. (shrink)

I have sometimes mused about writing an essay on what insights for understanding the doctor-patient relationship might be gleaned from P. F. Strawson's magisterial British Academy address, "Freedom and Resentment". This might seem an odd thought. The preoccupations of "Freedom and Resentment" are highly abstract, meta-ethical, and perhaps even meta-philosophical. Its aim is to turn philosophical discussion of moral responsibility away from two seductive yet unprofitable temptations.One temptation is the insistence that, if morality is to be all it seems, human (...) beings must in some respects not be fully subject to natural law. Yüksek din öğretimi kurumları diğer alanlar gibi günümüzde üniversite bünyesinde faaliyet göstermektedir. Ülkeler tarihsel, kültürel ve devlet yapıları doğrultusunda kendi kurumlarını kurup geliştirmekle birlikte, dünyadaki benzer diğer kurumların tecrübe ve birikimlerinin öğrenilmesi üniversitelerin gelişimi için önem arzetmektedir. Karşılaştırmalı çalışmaların bu konuda dikkate değer katkıları bulunmaktadır. Bu çalışmada, Malezya ve Türkiye'deki yüksek din öğretimi tarih, mevcut durum, hedefler, program yapısı, öğrenci kabulü ve mezun istihdam edilebilirliği gibi 6 farklı tema üzerinden karşılaştırılması hedeflenmektedir. Malezya ve Türkiye, nüfuslarının çoğunluğu Müslüman olmakla birlikte, devlet (...) ve toplum yapısı açısından birbirinden oldukça farklı iki ülkeyi temsil etmektedirler. Nitel, literatür bazlı olan bu çalışma doküman analizine dayanmaktadır. Her iki ülkedeki yüksek din öğretimini anlamak ve ortaya koymak amacıyla resmi belgeler, akademik makaleler ve internet kaynakları kullanılmıştır. Makalenin bulguları şöyledir: Türkiye'de yüksek din öğretiminin gelişimi kesintili olmuştur ve önemli siyasi değişimler yüksek din eğitimini etkilemiş olduğundan din siyaseti ile yakından ilişkilidir. Buna karşılık, Malezya'da yüksek din öğretiminin gelişimi daha istikrarlı olmuştur. Siyasi partilerin din siyaseti ve seçim hesapları Malezya'daki yüksek İslami öğretimini etkilemiş olsa da, bu en azından kurumlarının kapanmalarına veya sayılarının dramatik bir şekilde azaltılmasına yol açmamıştır. Güncele bakıldığında yüksek din öğretimi kurumlarının her iki ülkede de gelişmekte olduğu, ancak Türkiye'de bunun (en azıdan sayısal olarak) Malezya'dan daha hızlı olduğu anlaşılmaktadır. Yüksek din öğretiminin amaçlarıyla ilgili olarak, amaçların ve program çıktılarının ulusal bir kurum tarafından belirlendiği Malezya'da Ehl-i Sünnet ve'l-Cemaat ve dinini icra eden öğrencilerin yetiştirilmesine doğrudan atıflar vardır. Türkiye'de tarihsel olarak, ilahiyat fakültelerinin resmi misyonları, kısmen ilahiyatın laik bir üniversitedeki yerini meşrulaştırmak amacıyla modern amaçlara/kavramlara daha çok yer vermekte idi. Ancak son yıllarda açıkça İslami değer ve kavramlara atıflar yapan amaç ve misyonlar belirlenmektedir. Ancak ilahiyat/İslami ilimler fakültelerinin amaçlarını belirleyen ulusal bir kurumun olmaması nedeniyle, resmi misyon ve vizyon ifadeleri düzensiz görünmektedir, ancak akreditasyon süreci daha ortak ve bütünlüklü amaç ve program çıktılarının belirlenmesini sağlayabilir. Türkiye'de yüksek din öğretimi, Malezya’nın aksine, resmi olarak İslam'ın herhangi bir mezhebini benimsememekte olup, bu çoğulculuk ve çeşitliliğin olduğu modern bir toplum için daha uyumlu ve bütünleştirici olma fırsatı sunmaktadır. Malezya'da İslami bilgiyi mesleki bilgiyle bütünleştirmeyi amaçlayan farklı yüksek din öğretimi programları vardır. Bu, çok yönlü ve disiplinler arası programların ve uzmanlıkların oluşturulmasını sağlamıştır. Bu programlardan mezun olanlar ise güvenlikten finansa, yargıdan din hizmetlerine kadar çok farklı mesleklerde çalışabilmektedir. Türkiye’deki yüksek din öğretimi fakülteleri ise sadece tek bir program sunmakta olup, çoklu ve disiplinler arası programlar bulunmamaktadır. İki ülke arasındaki bir diğer önemli fark, öğrenci kabul sürecidir. Malezya'da farklı ortaöğretim sonrası eğitim/sınav sistemleri bulunurken, Türkiye'de merkezi bir üniversite giriş sınavı vardır. Farklı sınav sistemlerine rağmen, Malezya'da öğrencilerin İslami ilimler programlarına kaydolabilmeleri için İslam eğitimi, Arapça ve İngilizce konularında sağlam bir altyapıya sahip olmaları gerekmektedir; Türkiye'de ise üniversite sınavında din eğitimi ile ilgili çok az soru bulunmakta; bu nedenle, yüksek din öğretimi için din eğitimi, Arapça veya İngilizce herhangi bir altyapıya gerek bulunmamaktadır. Bu, din eğitimi geçmişi olmayanlar için bir fırsat olsa da, ilahiyat/İslami ilimler fakültelerinin Kuran okumayı öğretmek gibi en basit işlerden başlaması problemini gündeme getirmektedir. Son olarak, her iki ülkede de yüksek din öğretimi mezunlarının istihdam edilebilirliğinin en acil sorunlardan biri olduğu, ancak bu sorunun Türkiye'de Malezya'dan daha fazla olduğu anlaşılmaktadır. Our goal in producing this special issue is to encourage our colleagues to incorporate topics related to LGBT populations into bioethics curricula and scholarship. Bioethics has only rarely examined the ways in which law and medicine have defined, regulated, and often oppressed sexual minorities. This is an error on the part of bioethics. Medicine and law have served in the past as society's enforcement arm toward sexual minorities, in ways that robbed many people of their dignity. We feel that bioethics (...) has an obligation to discuss that history and to help us as a society take responsibility for it.We can address only a small number of topics in this special issue of the Hastings Center Report, and we selected topics we believe will stimulate discourse. Andrew Solomon offers an elegant overview of the challenges that bioethics faces in articulating a solid basis for LGBT rights. Timothy F. Murphy asks whether bioethics still faces issues related to lesbian, gay, and bisexual people, given the deletion of homosexuality as a disease and the progress toward same‐sex marriage. Jamie Lindemann Nelson's essay addresses the search for identity for transgender persons and the role of science in that search. Two articles, those by Brendan S. Abel and by Jack Drescher and Jack Pula, take up the complex issue of medical treatment for children who reject their assigned birth gender. Celia B. Fisher and Brian Mustanski address the special challenges of engaging LGBT youth in research, balancing the need for better information about this vulnerable group against the existing restrictions on research involving children. Tia Powell and Edward Stein consider the merits of legal bans on psychotherapies intended to change sexual orientation, particularly in the light of current research on orientation. Mary Beth Foglia and Karen I. Fredricksen‐Goldsen highlight health disparities and resilience among LGBT older adults and then discuss the role of nonconscious bias in perpetuating disparities. Stephan Davis and Nancy Berlinger assess the challenges of access to care and health policy for transgender persons. Edward J. Callahan et al. tackle the ways in which diverse aspects of medicine should change to better incorporate the needs of LGBT patients, including through use of the electronic medical record, education of health professionals, and recruitment efforts for LGBT health professionals. Virginia Ashby Sharpe and Uchenna S. Uchendu describe multifaceted efforts within Veterans Administration facilities to create change for LGBT veterans across the largest integrated health care network in the United States. Lance Wahlert and Autumn Fiester find a mixed record in the use of case studies in teaching about LGBT issues. (shrink)

Ethics for Enemies comprises three original philosophical essays on torture, terrorism, and war. F. M. Kamm deploys ethical theory in her challenging new treatments of these most controversial practical issues. First she considers the nature of torture and the various occasions on which it could occur, in order to determine why it might be wrong to torture a wrongdoer held captive, even if this were necessary to save his victims. In the second essay she considers what makes terrorism wrong--whether it (...) is the intention to harm civilians, rather than harm to them being 'collateral damage,' or something else--and whether terrorism is always wrong. The third essay discusses whether having a right reason, in the sense of a right intention, is necessary in order for a war to be just. Kamm then examines ways in which the harms of war can be proportional to the achievement of the just cause and other goods that war can bring about, so as to make the declaration of war permissible. Initially, we perceive an indefinite extension imprecisely, a spread C ; this perception can be visual, aural, or tactile.

At last scholars are recognizing that the great generative architectonics of idealism’s account of self-consciousness would demand or imply, from a genealogical perspective, an unconscious. Yet, between Foucaultian inspired analyses of madness in Hegel, and Slavoj Zizek’s Lacanian readings of the unconscious in the work of F. W. J. Schelling, there has been essentially no mention of J. G. Fichte. As an attempt to redress this failure, I will begin to sketch Fichte’s own unique articulation of an unconscious (Unbewusst) by (...) highlighting three unique aspects or perspectives: (a) the idea of a pre-conscious, self-affective self; (b) the notion of the self-seeing eye; and (c) his own first hand involvement with dynamic psychiatry’s phenomena of magnetic rapport. This exposition of the unconscious in Fichte has two distinct ends. First, it stands as one of the first sustained expositions of the unconscious in the work of Fichte. This analysis which places Fichte’s work in the broader genealogy of dynamic psychiatry, however, also stands as a critique of the Freudian psychoanalytic model of the unconscious. (shrink)

This paper discusses the important paper by Paul Thagard on the pathway version of mechanistic explanation that is currently used in chemical explanation. The author claims that this method of explanation has a respectable pedigree and can be traced back to the Chemical Revolution in the arguments used by the Lavoisier School in their theoretical duels with Richard Kirwan, the proponent of a revised phlogistonian theory. Kirwan believed that complex chemical reactions could be explained by recourse to affinity tables that (...) catalogued the attraction that various simple bodies possessed towards each other. To explain was in effect to make a delayed prediction, it is not enough just to show how a phenomenon fits into the discernible patterns of the world. Lavoisier, Fourcroy and their colleagues used pathway reasoning, although disguising this fact by suggesting that affinities varied when subjected to n-body situations. (shrink)

This paper is a summary and extension of almost four decades of research directed toward an explication of the human mind. To achieve a precise, testable proposition that defines mind, I follow a historically rich tradition of materialism. First, an empirical basis is established wherein electropsychologically measured events from the brain, eyes, somatic and speech musculature occur almost simultaneously during a variety of cognitions. The inference is that these covert reactions form components of neuromuscular circuits governed by cybernetic principles. Conversely, (...) when the striated musculature is totally inactive, cognitions are absent. The conclusion is that muscular components of the circuits are necessary for cognitions. An explication of the human mind emerges as the selective interaction of bodily systems to generate contents of mind and to program covert and overt behavior.
